Terms & Conditions of Business

 

1. Definitions


“The Crematorium” means Breckland Crematorium Limited.


“Customer” means any person, funeral director, company, organisation, executor, administrator, applicant for cremation, representative of the deceased, or other individual or entity instructing or requesting the Crematorium to provide Services.


“Services” means all cremation, memorial, ancillary and related services supplied by the Crematorium.


2. Acceptance of Bookings


2.1 All bookings are subject to availability and acceptance by the Crematorium.


2.2 The Crematorium reserves the right to refuse or decline any booking at its absolute discretion.


2.3 A booking shall only become confirmed once:
• all statutory documentation has been received and accepted;
• all required information has been provided;
• where applicable, payment has been received in full or credit facilities are in place.


3. Payment Terms

Customers Without Approved Credit

3.1 Customers who have not been granted an approved credit account must pay all charges in full before a cremation booking is confirmed.


3.2 No cremation service will be confirmed or carried out until cleared funds have been received.


3.3 The Crematorium reserves the right to cancel or postpone any provisional booking where payment has not been received by the required date.

Customers With Approved Credit Facilities


3.4 Credit facilities are available only following completion of the Crematorium’s Credit Application and written approval by the Crematorium.


3.5 Approved account holders shall pay all invoices within thirty (30) days of the invoice date unless otherwise agreed in writing.


3.6 Granting of credit is entirely at the discretion of the Crematorium and may be refused without explanation.


3.7 Credit facilities may be reviewed, amended, suspended or withdrawn at any time.

 

4. Overdue Accounts

 

4.1 Where payment is not received by the due date, the Crematorium reserves the right to:
• suspend credit facilities immediately;
• require payment in advance for all future bookings;
• refuse new bookings until outstanding balances are cleared;
• reduce or withdraw any credit limit.


4.2 The Customer shall remain liable for all outstanding invoices together with any reasonable costs incurred in recovering the debt.


4.3 The Crematorium reserves the right to charge statutory interest and compensation in accordance with the Late Payment of Commercial Debts (Interest) Act 1998, where applicable.



5. Prices


5.1 Charges shall be those published by the Crematorium and in force on the date the cremation takes place unless otherwise agreed in writing.


5.2 The Crematorium reserves the right to amend its fees at any time.


5.3 Where prices are to be increased, the Crematorium will provide not less than fourteen (14) days’ written notice of the revised prices to Approved Credit Customers.


6. Documentation


6.1 It is the responsibility of the Customer to ensure all statutory cremation documentation is accurate, complete and submitted within the required timescales.


6.2 The Crematorium reserves the right to delay or refuse any cremation where documentation is incomplete or does not comply with legal requirements.



7. Customer Responsibilities


The Customer warrants that:


• all information supplied is accurate;
• all statutory requirements have been met;
• they have authority to instruct the Crematorium on behalf of the applicant for cremation;
• all fees due under these Terms will be paid.



8. Cancellation


Where a confirmed booking is cancelled after arrangements have been made, the Crematorium reserves the right to charge for costs already incurred.


9. Memorials and Garden of Remembrance


9.1 Any Customer purchasing, applying for, renewing or otherwise arranging a memorial or memorial-related service within the Breckland Crematorium Garden of Remembrance agrees to comply with the Crematorium’s current Garden of Remembrance Rules, as amended from time to time.


9.2 The Garden of Remembrance Rules form part of these Terms and Conditions of Business and are available on request and/or published on the Crematorium’s website.


9.3 It is the Customer’s responsibility to ensure that they, and any person acting on their behalf or visiting the memorial, comply with the Garden of Remembrance Rules.


9.4 The Crematorium reserves the right to remove, relocate, alter or decline any memorial, ornament, tribute, planting, decoration or other item placed within the Garden of Remembrance where it is considered to be inconsistent with the Garden of Remembrance Rules, unsafe, offensive, likely to impede maintenance, or otherwise unsuitable.


9.5 Failure to comply with the Garden of Remembrance Rules may result in the suspension, cancellation or non-renewal of any memorial agreement, without prejudice to any other rights or remedies available to the Crematorium.


10. Limitation of Liability


Nothing within these Terms excludes liability where exclusion is prohibited by law.
Subject to the above, the Crematorium’s liability shall be limited to the fees paid for the relevant services.


11. Force Majeure


The Crematorium shall not be liable for delays or failure to perform its obligations where such failure arises from circumstances beyond its reasonable control.


12. Right to Refuse Services


The Crematorium reserves the right to refuse any booking where:


• payment terms have not been met;
• statutory documentation is incomplete;
• legal requirements have not been satisfied;
• there is a material breach of these Terms and Conditions.


13. Entire Agreement


These Terms and Conditions constitute the entire agreement between the parties unless varied in writing by the Crematorium.


14. Governing Law


These Terms and Conditions shall be governed by the laws of England and Wales and any dispute shall be subject to the exclusive jurisdiction of the courts of England and Wales.
